The Kano State Police Command has refused to comply with the directives by Governor Abba Yusuf to arrest the deposed Emir of Kano, Aminu Ado Bayero, Leadership reported.
According to LEADERSHIP, Governor Yusuf gave the directives for the arrest of the disposed Emir, alleging that he was disrupting the peace.
Recall that development comes amid a legal standoff following a court order to maintain the status quo pending the determination of judgment.
But the Kano State Governor, early Saturday morning, issued an order for the Commissioner of Police to arrest the deposed Emir. The order came shortly after Aminu Ado Bayero’s arrival to the State early on Saturday morning.
At a press briefing, the Commissioner of Police, Muhammad Usaini Gumel confirmed the Governor’s directives. He, however, stated that the Command is adhering to a court order that mandates the status quo until a ruling on June 3, 2024.
“We are complying with the Court order that the status quo must be maintained. This is until the court gives its judgment,” the Commissioner stated.
Recall that this media has reported that a Federal High Court in Kano had issued an ex-parte order. The order temporarily prevented the reinstatement of Muhammadu Sanusi II as the Emir of Kano pending the determination of a suit before it.
According to report, the injunction was issued after Alhaji Aminu Bappa Dan Agundi, a prominent traditional titleholder in Kano filed a suit challenging the recent changes to the Kano State Emirate Council law.
Presiding over the case, Justice A.M. Liman, issued an interim injunction suspending the implementation of the Kano State Emirates Council (Repeal) Law, 2024.
The law, which was enacted by the Kano State House of Assembly, was assented to by Governor Yusuf on Thursday. The law is aimed to abolish the Emirates created under the previous administration of Governor Abdullahi Ganduje.
But the court’s injunction specifically restrains the State Government and related agencies from enforcing or operationalizing the new law. It also effectively halted any alterations to the traditional structures established in 2019.
Delivering the judgment, Justice Liman emphasized the necessity of maintaining the status quo. This is to prevent further escalation until the court could fully deliberate on the matter.
But reacting to the judgment, Governor Yusuf said judgement cannot override the KSHA which passed through due process. The Governor, therefore, criticized the judicial intervention, alleging that Justice Liman issued the interim injunction while in the US.
Yusuf, also declared his intention to report what he perceived as judicial overreach to the Nigerian Governors’ Forum. This is even as he went ahead to present letter of appointment to Emir Sanusi Lamido Sanusi.
“The case is scheduled for a hearing on June 3, 2024, focusing on the fundamental rights application.
“The court has directed that all relevant documents be served on the Inspector General of Police in Abuja. This is to ensure due process is maintained.
